OFFICIAL RULES

NO PURCHASE NECESSARY.  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU HAVE NOT YET WON.

1. Agreement to Official Rules:
By entering the The Alienware Presents (AW Defy Boundaries Campaign): Defy Memes Challenge; The Limitless Reality Challenge; The Break Free Challenge; and the Trending Challenge (the “Contest”) You (“You”, “Your” or “Entrant”) hereby fully and unconditionally agree to these official rules (the “Official Rules”) and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Contest.  Winning a prize is contingent upon fulfilling all requirements set forth herein. Any violation of these Official Rules will result in disqualification.

2. Eligibility: 
All participants must (a) be at least 18 years of age or older or the age of majority in their jurisdiction of residence, whichever is older, (residents of Alabama or Nebraska must be at least 19 years old; residents of Mississippi must be at least 21 years old), at the time of entry; (b) possess a valid form of identification; and, (c) be a legal resident of: one of the 50 United States or the District of Columbia, Australia, Belgium, Canada (excluding the Province of Quebec), Czech Republic, Denmark, Finland, France, Germany, Hungary, Ireland, Japan, Mexico, the Netherlands, New Zealand, Norway, Spain, Sweden, Switzerland, or the United Kingdom.  All applicable federal, national, state, provincial and local laws and regulations apply.  VOID IN ALL JURISDICTIONS WHERE PROHIBITED BY LAW OR REGULATION, AND JURISDICTIONS WITH LAWS THAT WOULD REQUIRE REGISTRATION, TRUST ACCOUNT, AND/OR POSTING OF A BOND, OR ANY OTHER REQUIREMENTS THAT HAVE NOT BEEN SATISFIED, OR RESTRICTED OR TAXED BY LAW (“Excluded Territory”). Residents of an Excluded Territory are not eligible. Employees and representatives of Dell Inc., its subsidiaries, Audience Awards Inc (“AudPop”), and any of their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Government employees including all federal, state, county, city or municipal government employees, state funded universities and colleges, all types of public officials including elected officials, private individual or firms where the Government has outsourced Government functions, and K-12 employees are not eligible. Employees of the City of New York are not eligible.
NOTICE TO HEALTHCARE EMPLOYEES: If You are employed in the healthcare industry, prior to awarding any prizes you will be required to obtain certification that acceptance of the contest prize is permitted in accordance with applicable law and ethics policies of Your employer.

(individually and collectively the “Website”) and follow the links and instructions to complete and submit the registration form, including a valid home address.  P.O. Boxes are not permitted.  Then, follow the directions to submit (the “Submission”) By uploading your Submission, you agree that it conforms to the Submission Guidelines and Content Restrictions as defined below (collectively, the “Guidelines and Restrictions”) and that Sponsor may disqualify You from the Contest if it believes, in its sole discretion, that your Submission fails to conform to the Guidelines and Restrictions. 

Submission Guidelines:  

  • The Submission must be in video format;
  • 10-15 seconds in duration;
  • The Submission cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means.
  • Vertical (9:16) but consider framing for square (1:1) if we use it for in-feed IG posts.
  • Alienware will provide all typography, logos, colors and other brand guidelines for use.
Content Restrictions:
  • The Submission must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
  • The Submission must not disparage Sponsor, Administrator or any other person or party affiliated with the promotion and administration of this Contest;
  • The Submission must not feature brand names or trademarks other than Dell’s mark, which Entrant has a limited license to use to incorporate into his/her Submission for this Contest;
  • The Submission must not contain text not created by Entrant;
  • The Submission must not contain text that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
  • The Submission must not contain text that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
  • The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where Submission is created.
Creative Considerations:
  • Find the right balance between the vibe of UGC and what we need for a marketing campaign. This is a fine line because we want the content to feel authentic but at the same time the takeaway needs to be Alienware. There needs to be a clear relation to Gaming / Alienware / “Defy Boundaries” campaign, and that needs to come through right off the bat.
  • It should be gaming-related and ideally creators will be gamers, so that the knowledge of our audience and brand is on point. If they are not gamers themselves, it at least needs to come across as they are, or the character they’re embodying is.
  • Aesthetic Inspiration: slick, energized, empowered, dynamic, aspirational, brave, electric, bold, boundless, driven, self confident.
  • Must feel authentic and not overly polished, but feel free to exercise editing skills to create visually compelling creative.
  • If Alienware products are able to be used, please incorporate. Do not highlight or feature any other brand / technology besides Alienware.
Limit: Each Entrant may enter each Contest one (1) time during the Contest Period.  Submissions received from any person or email address in excess of the stated limit will be void. Submissions generated by script, macro or other automated means are void. Entrant must have permission from all individuals mentioned in the Submission (if any) to use their name and likeness in the Submission and to grant the rights set forth herein.  If requested, Entrant must be able to provide such permissions in a form acceptable to Sponsor.  Uploading a Submission constitutes Entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes.  If requested, Entrant will sign any documentation required for Sponsor or its designees to make use of the non-exclusive rights Entrant is granting to use the Submission. Released Parties (as defined in Section 9, below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Submissions, all of which will be void.

In the event of a dispute regarding any Submission, the authorized account holder of the email address used to register will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.

Defy Memes:
CHALLENGE: Create a fun, “meme-like” vertical 10-15 second vertical social media video of yourself batting away things (or words describing things) that you want to defy. Appearance, performance, and words featured in the video must instantly relate to gaming, Alienware, and/or the “Defy Boundaries” campaign.

OBJECTIVE: Your concept should be original, fun, and inspiring. It should come from real gamers, or at least appear to be from a gamer. It should be boundary defying, fresh and told from your unique perspective. What does defying boundaries mean to a gamer? Consider how you would utilize TikTok’s in-app creative elements to make your video authentic and engaging through filters, effects, text animation, audio, and the video edit itself. Describe how you would creatively portray that in a 10-15 second vertical social video. Let’s have fun and defy boundaries!

Trending Challenge:
CHALLENGE: Using popular TikTok/Instagram video trends. Create a 0:10-0:15s video that instantly relates to gaming and what it means to Defy Boundaries.
OBJECTIVE: Your concept should be original, fun, and inspiring. It should come from real gamers, or at least appear to be from a gamer. It should be boundary defying, fresh and told from your unique perspective. What does defying boundaries mean to a gamer? Consider how you would utilize TikTok’s in-app creative elements to make your video authentic and engaging through filters, effects, text animation, audio, and the video edit itself. Describe how you would creatively portray that in a 10-15 second vertical social video. Let’s have fun and defy boundaries!

Break Free Challenge:
CHALLENGE: Create a fun 0:10-0:15s video in which we use relevant and exciting
TikTok/Instagram video transitions to show a before and after state that relates to the theme of Defy Boundaries. The more complex the transition, the better. The skillful transition will be key in relating the creative back to our theme of defying boundaries while also elevating the creative, without making it feel like an overly polished production.
OBJECTIVE: Your concept should be original, fun, and inspiring. It should come from real gamers, or at least appear to be from a gamer. It should be boundary defying, fresh and told from your unique perspective. What does defying boundaries mean to a gamer? Consider how you would utilize TikTok’s in-app creative elements to make your video authentic and engaging through filters, effects, text animation, audio, and the video edit itself. Describe how you would creatively portray that in a 10-15 second vertical social video. Let’s have fun and defy boundaries!

Limitless Reality Challenge:
CHALLENGE: Create and submit a 10-15 second reality-bending video that uses editing and
camera techniques to make it seem like we’re seeing two different realities, encompassing the idea that Alienware enables you to defy boundaries. For example, you might walk through a mirror to find yourself in an altered reality. Or do you jump and crush through the floor into an immersive and gaming-inspired environment? The opportunities are limitless, which should come through in your creative.
OBJECTIVE: Your concept should be original, fun, and inspiring. It should come from real
gamers, or at least appear to be from a gamer. It should be boundary defying, fresh and told from your unique perspective. What does defying boundaries mean to a gamer? Consider how you would utilize TikTok’s in-app creative elements to make your video authentic and engaging
through filters, effects, text animation, audio, and the video edit itself. Describe how you would
creatively portray that in a 10-15 second vertical social video. Let’s have fun and defy boundaries!

YOUR REPRESENTATIONS:  By submitting an Entry, You affirmatively represent that You have read and agree to these Official Rules. In addition, by submitting an Entry, You represent that (a) the Entry is original, (b) You are the sole creator of the Entry, (c) the Entry does not infringe the intellectual property rights, including, any patent, copyright, trademark or other proprietary rights of any third party, (d) the Entry has not previously been entered in any other contest or competition, and (e) the Entry has not been previously published in any medium, (f) the Entry does not violate any local, state, national or foreign laws.

U.S. DIGITAL MILLENNIUM COPYRIGHT ACT NOTICE

If You believe that Your work has been copied in any way without Your permission, please provide the following information to our agent to receive Notification of Claimed Copyright Infringement identified below. Your notice must contain the following:
 

  • Your electronic or physical signature;
  • A description of the work You claim has been infringed;
  • Identification of the work You claim infringes the copyrighted work and a description of where it is located on the Dell website;
  • Your address, telephone number and email address;
  • A statement by You that You have a good faith belief that the infringing use is not authorized by the copyright owner, the copyright owner’s agent or by law; and
  • A statement by You, under penalty of perjury, that the above information in Your notice is accurate and that You are the copyright owner or authorized to act on the copyright owner’s behalf.

6. Winner Determination:
After the conclusion of the Contest Period, a panel of qualified judges determined by Sponsor in its sole discretion will select the potential winners from among all eligible Submissions received, based on an application of the following criteria (“Judging Criteria”):

  • Creativity/Originality (20%);
  • Technical Merit (20%);
  • Fresh Diverse Perspective (10%); and
  • Adherence to Assignment (50%)
In the event of a tie, the Entrant whose Submission received the higher score in Creative/Originality and Adherence to Assignment, as determined by the qualified judges in their sole discretion, will be deemed the potential winner. Sponsor reserves the right to select fewere than the stated number of winers, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions.

7. Winner Requirements:
Entrants selected as potential winners (“Potential Winners”) are subject to verification of eligibility and compliance with these Official Rules. The Administrator will attempt to notify each Potential Winner via email, mail or phone within approximately 2 weeks after Contest ends.
In order to be declared a winner, each Potential Winner may be required:

  1. complete and return to Administrator (or its authorized agent), by the deadline specified in the winner notification, a written affidavit of eligibility (or declaration and release) and publicity release form (collectively, the “Release”), releasing the Administrator from any liability in connection with this Contest or the acceptance, possession, use or misuse of any Prize to the fullest extent permitted by the laws of each Potential Winner’s jurisdiction of residence;
  2. If entrant is selected as a Potential Winner of a Prize valued at or above $600 USD (or other amount as might be provided by the law of the jurisdiction in which the Potential Winner resides), complete all tax documentation as may be required by the law of the jurisdiction in which the Potential Winner resides (“Tax Documentation”), if any;
If a potential winner cannot be contacted, fails to sign and return the Release, any required Tax Documentation within the required time period (if applicable), does not comply with these Official Rules or prize is returned as undeliverable, potential winner forfeits the prize.  If a potential winner is disqualified for any reason, the prize may be awarded to a runner-up determined by the qualified judges, in Sponsor’s sole discretion. Only three (3) alternate winners may be determined, after which the applicable prize will remain un-awarded.  Acceptance of any prize shall constitute and signify each winner’s agreement and consent that Sponsorand its designees may use the winner’s name, city, state, country, likeness, Submission and/or prize information in connection with the Contest for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.  Each winner shall irrevocably grant, transfer, convey and assign to Sponsor the entirety of the rights in and to the Submission and all renewals and extensions of copyright, and the right to secure copyright registrations thereto in perpetuity including, without limitation, the rights to use the Submission for any and all purposes in any and all media whether now known or hereafter developed, on a worldwide basis, in perpetuity. Each winner accepts and acknowledges that Sponsor shall not be obligated to use the Submission and that Sponsor in its sole discretion shall have the right to refrain from using the Submission. By entering, You agree that You are in compliance with all of Your employers’ rules, policies, and procedures that relate accepting prizes. Each winner will indemnify Sponsor, Released Parties (as defined in Section 9, below) and any licensee of Sponsor against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these terms.  Prizes will be fulfilled 8 – 10 weeks after conclusion of the Contest.

Approximate Retail Value (“ARV”) of the 1st place prize is: $2,000 USD Per Contest. The ARV of the 2nd place prize is $1,000 USD per Contest. The actual value of electronic prizes is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed.

Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Prizes not manufactured or sold by Dell will be awarded without warranty of any kind, express or implied, without limitation.  Prizes awarded will not in any way influence any decision in doing business with Dell.  Prize was not given in connection with or related to any sale or commercial transaction or promise related thereto. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.  Winners are responsible for all taxes and fees associated with prize receipt and/or use. Limit: One (1) prize per person/household. Total ARV of all prizes: $12,000 USD.

9. Limitations of Liability & Releases:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT ADMINISTRATOR, and any of Sponsor’s other agencies, suppliers, prize providers, or contractors (“Released Parties”) HAVE NO LIABILITY WHATSOEVER FOR, AND ENTRANTS SHALL HOLD THE RELEASED PARTIES HARMLESS AGAINST, ANY LIABILITY FOR ANY INJURIES, CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES OF ANY KIND (INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM (A) ENTRY OR PARTICIPATION IN THIS CONTEST, INCLUDING ACCESS TO AND USE OF THE CONTEST WEBSITES, (B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR PRIZE DELIVERY, OR (C) THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE.  RELEASED PARTIES ARE NOT RESPONSIBLE FOR ANY UNDELIVERED E-MAILS, INCLUDING WITHOUT LIMITATION E-MAILS THAT ARE NOT RECEIVED BECAUSE OF A WINNER’S PRIVACY OR SPAM FILTER SETTINGS WHICH MAY DIVERT ANY NOTIFICATION OR OTHER E-MAIL, INCLUDING ANY WINNER NOTIFICATION E-MAIL, TO A SPAM OR JUNK FOLDER.  Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore, such exclusions may not apply to you, please see Section 12 below.
Without limiting the foregoing, but subject to Section 12 below, the  Released Parties shall not be responsible for: (a) any incomplete or inaccurate information that is caused by Contest website users, or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of submissions in the Contest; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, Entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any e-mail to be received by or from the Administrator for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user’s computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Contest; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (i) technical, pictorial, typographical or editorial errors or omissions contained herein.

10. General Conditions:
Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine the winners from among all non-suspect, eligible Submisions received up to time of such action using the judging procedure outlined above. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Submission process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated Submissions. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees from any such person to the fullest extent permitted by law.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Disputes:
THE TERMS OF SERVICE THAT ARE INCORPORATED INTO THESE OFFICIAL RULES CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION AND JURY TRIAL WAIVER CLAUSES, WHICH ARE APPLICABLE TO ALL MEMBERS OF THE PROGRAM THAT RESIDE OUTSIDE OF THE EUROPEAN ECONOMIC AREA (“EEA”), SWITZERLAND, AND NEW ZEALAND.  SOME JURISDICTIONS DO NOT ALLOW THE ABOVE RESTRICTIONS IN THE EVENT OF DISPUTE OR LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU – PLEASE SEE SECTION 12 BELOW.  Subject to Section 12, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and the Administrator in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Maryland without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Maryland.

12. ELIGIBLE NON-U.S. RESIDENTS ONLY:
Country Specific Notices: If any provision of these rules is invalid under the law, rules or regulations of a particular country, it will only apply to the extent permitted and you shall not be deprived of the protection afforded to you under your own laws, rules, or regulations. In addition to the tax liability disclosures in these rules, winners are subject to abide by the income reporting and, if applicable, the payment of any taxes and withholdings due per the laws, rules and regulations of the winners’ country of residence and the existence and level of such taxes and withholdings may change over time.
For European Economic Area and Switzerland: The limitation and exclusions of liability set out above do not apply to you but you and the Administrator agree that: (a) the Administrator shall not have any liability for events which neither the Administrator nor its suppliers could have foreseen or prevented even if the Administrator or its suppliers had taken reasonable care; and (b) as you are a consumer and not entering the Contest in connection with any business the Administrator shall not have any liability for any commercial or business-related damages, costs or losses.  The Administrator will be liable to you for death or personal injury caused by its negligence or if it acts fraudulently.  The Administrator will try and solve any disagreements with you quickly and efficiently.  If you are not happy with the way the Administrator deals with any disagreement you and the Administrator may agree to refer the matter to arbitration, but you and the Administrator are not restricted from bringing court proceedings in your country or elsewhere.  Local mandatory laws may be applied.  The choice of governing law and jurisdiction (including the alternate dispute resolution) does not deprive you of the protection afforded to you under your own laws and such provisions that cannot be derogated from by agreement by virtue of the law of your jurisdiction and which is enforced or upheld in a Court or forum other than arbitration.
For Residents of Sweden:  In addition to the above-mentioned dispute resolution mechanisms, consumers also have the right to refer a dispute to a competent alternative dispute resolution body. In Sweden such body is The National Board for Consumer Disputes (ARN) (www.arn.se). Consumers also have the right to send in complaints to the Swedish Consumer Agency.
For Residents of Finland:  In addition to the above-mentioned dispute resolution mechanisms, consumers also have the right to refer a dispute to a competent alternative dispute resolution body. In Finland such body is the Consumer Disputes Board (www.kuluttajariita.fi), but consumers should contact the Consumer Advisory Service (www.kuluttajaneuvonta.fi) prior to taking the matter to the Consumer Disputes Board.
For Residents of the Netherlands: Complaints regarding the Contest may be reported by contacting the Sponsor at support@audpop.com If entrant feels that his or her complained has not been adequately addressed, he or she can file a complaint at: Kansspelautoriteit, Postbus 20301, 2500 EH Den Haag.
For Residents of New Zealand: Where the Administrator have not complied with their obligations under the Consumer Guarantees Act 1993 they may be liable for any loss or damage resulting from the failure to comply so long as the loss or damage was reasonably foreseeable.  The Administrator may also be liable for loss or damage to your property that results from intentional conduct or the gross negligence of staff or employees of the Administrator. Other than as described in this paragraph, the Administrator are not liable to you for any losses, damage, costs, distress or inconvenience suffered by you or any other person; or loss or damage to any property; or for any losses, damages, costs, distress or inconvenience as a result of a service disruption. For Residents of Australia: Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be the Administrator  (including its respective officers, employees and agents) excludes all liability (including negligence) for any loss or damage whatsoever which is suffered by you (including, without limitation, indirect or consequential loss), or for personal injury suffered or sustained, as a result of you taking part in, winning or using any of the prizes, except for any liability which cannot be excluded by law.

Entrant’s Personal Information:  Sponsor and its authorized agents will collect, use, disclose and otherwise process the personal information you provide when you enter the Contest as set forth in the Sponsor’s Online Privacy Notice: www.dell.com/privacy, and in particular for the purposes of administering the Contest, Prize fulfillment, recordkeeping and for compliance with our legal obligations in all jurisdictions in which the Contest is available.  By entering the Contest, you understand and acknowledge that your personal information will be used for these purposes and as set forth in our Online Privacy Notice.  You also have certain rights regarding our processing of your personal data under certain circumstances (which may include the rights of access, portability, correction, deletion, objection and restriction); for information about your rights and how to exercise them please consult our Online Privacy Notice or contact us at: support@audpop.com
Transfers to the United States. The Contest websites and the personal information you submit (as detailed in these Official Rules) will be hosted and processed, for the purposes described above, on servers in the United States, where the Administrator is located, and the personal information you provide may therefore also be subject to the laws of the United States, which may not provide the same type or level of data protection as the laws in your country.  We take steps to ensure that personal data transferred outside your home jurisdiction is subject to adequate safeguards as set forth in our Online Privacy Notice (to request information about these safeguards or privacy practices, contact us as set forth in the Online Privacy Notice: www.dell.com/privacy. By entering into the Contest you acknowledge and agree to your information being treated as per the above mentioned Online Privacy Notice and to it being transferred to the United States.
Users outside the European Economic Area and Switzerland: By entering the Contest, you acknowledge that you understand and agree to our Online Privacy Notice.  By accepting a Prize, each winner agrees to Sponsor’s use of his/her name, city/state/province of residence, picture, biographical information, statements, voice and likeness in any advertising and publicity Sponsor may conduct relating to the Contest in any media or format, whether now known or hereafter developed, including but not limited to the World Wide Web, at any time or times in perpetuity, without further compensation or notice, except where prohibited by law. Aggregate and anonymized Contest winner information may be used by the Sponsor to communicate about the Contest to its retailers and distributors.
